CMPND is a training brand operated by CMPND Technologies Ltd. This Privacy Policy applies to the CMPND website and online store at cmpnd.app (the "Store"), and to the CMPND mobile application for iOS and Android (the "App"). Together the Store and the App, including all related information, content, features, tools, products and services, are referred to as the "Services".
The CMPND App is published on the Apple App Store and Google Play by CMPND Technologies Ltd, which is also the data controller of your personal information for the purposes of applicable data protection law. The Store is powered by Shopify, which enables us to provide the online store to you.
This Privacy Policy describes how we collect, use, and disclose your personal information when you visit or use the Services, make a purchase, create an account, use the App, or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.
Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described here.
Personal Information We Collect or Process
When we use the term "personal information," we are referring to information that identifies or can reasonably be linked to you or another person. Personal information does not include information that is collected anonymously or that has been de-identified so that it cannot identify or be reasonably linked to you. Depending on how you interact with the Services, we may collect or process the following categories of personal information, including inferences drawn from it:
Contact details including your name, address, billing address, shipping address, phone number, and email address.
Account information including your username, password, security questions, preferences and settings, and the training profile you create in the App.
Financial information including payment card information, financial account information, transaction details, form of payment, payment confirmation and other payment details. In-app subscriptions are processed by Apple and Google; we do not receive or store your full payment card details for App purchases.
Transaction information including the items you view, add to your cart, add to your wishlist, or purchase, return, exchange or cancel, and your past transactions in the Store.
Training and progress information including the workouts and programmes you follow, the exercises, sets, reps and weights you log, your personal records, your bodyweight entries, and the notes you add to your sessions.
Progress photos and videos including any images or videos you choose to upload to the App to track your physical progress (for example, the Progress Picture and Compare Photo features).
Health and fitness data as described in the "Health and Fitness Data" section below.
Location data including your approximate (coarse) location — your country and general area — which we derive from your IP address using a third-party geolocation service. We do not collect precise or GPS-level location from your device.
Communications with us including the information you include when you contact us, for example when sending a customer support enquiry.
Device information including information about your device, browser, or network connection, your IP address, and other unique identifiers.
Usage information including information about how and when you interact with or navigate the Services.
Health and Fitness Data (Apple Health / Health Connect)
If you use the CMPND App and grant permission, we read the following data from Apple Health (iOS) or Health Connect (Android) to personalise your training and track your progress: workouts and exercise sessions, heart rate, heart-rate variability, VO2 max, body weight, sleep, steps, distance, and active energy.
With your permission, CMPND also writes your completed training sessions and their estimated total calories back to Apple Health / Health Connect.
This data is used solely to provide in-app coaching, progress tracking, and recovery/readiness features. It is processed on your device and synced to your CMPND account over an encrypted connection. We never sell your health data, never use it for advertising or marketing purposes, and never share it with third parties for their own purposes. Our use of data received from Apple Health and Health Connect complies with the applicable platform policies, including Google's Health Connect Permissions policy and Limited Use requirements, and Apple's HealthKit requirements.
You can revoke access at any time in Apple Health, Health Connect, or in CMPND under Settings → Wearable. You can request deletion of synced health data at any time by contacting us at hello@cmpnd.app; we will delete it within 30 days. Health data is retained only for as long as your account remains active or as needed to provide these features.
Progress Photos and Videos
The App allows you to upload photos and videos to record and compare your physical progress over time. These images are optional and are only collected if you choose to add them.
Progress photos and videos are used solely to provide the in-app progress-tracking and comparison features to you. We do not sell them, use them for advertising, or share them with third parties for their own purposes. They are stored against your account over an encrypted connection and can be deleted by you at any time within the App, or by contacting us at hello@cmpnd.app. They are retained only for as long as your account remains active or until you delete them.
Location
We do not collect precise or GPS location from your device, and the App does not ask for location permission. Instead, we determine your approximate location — your country and general area — from your IP address, using a third-party geolocation service. We use this to understand the regions our users are in and to tailor content to your region. Because it is derived from your IP address, this is a normal part of connecting to our Services rather than something controlled by a device location setting. We do not sell this information and we do not use it for advertising.
Personal Information Sources
We may collect personal information from the following sources: directly from you, including when you create an account, visit or use the Services, communicate with us, or otherwise provide us with your personal information; automatically through the Services, including from your device when you use the App or visit the Store, and through the use of cookies and similar technologies; from our service providers, including when we engage them to enable certain technology and when they collect or process personal information on our behalf; and from our partners or other third parties.
How We Use Your Personal Information
Depending on how you interact with us or which of the Services you use, we may use personal information for the following purposes:
Provide, tailor, and improve the Services. To provide you with the Services and perform our contract with you, including to create and manage your account, deliver and personalise your training programmes and workout recommendations, track your progress and personal records, process your payments and in-app subscriptions, fulfil Store orders, arrange shipping, facilitate returns and exchanges, enable you to post reviews, remember your preferences, and improve the Services.
Marketing and advertising. To send you marketing and promotional communications by email, text message or post where permitted, and to show you relevant offers, based on your activity with us. You can opt out of marketing communications at any time.
Security and fraud prevention. To authenticate your account, provide a secure payment and shopping experience, and detect, investigate or take action regarding possible fraudulent, illegal, unsafe, or malicious activity. If you register an account, you are responsible for keeping your credentials safe.
Communicating with you. To provide customer support, respond to your enquiries, and maintain our relationship with you.
Legal reasons. To comply with applicable law or respond to valid legal process, and to enforce or investigate potential violations of our terms or policies.
Third-Party Services Used by the App
To provide the App we use a small number of third-party services that may process your personal information on our behalf or as independent controllers under their own privacy policies:
Sign-in providers. If you choose to sign in using Google or Apple, that provider processes your sign-in credentials to authenticate you. We receive limited profile information (such as your name and email address) to create and manage your account.
Apple Health and Health Connect, as described in the "Health and Fitness Data" section above.
App store payment processing. In-app subscriptions are processed by Apple (App Store) or Google (Google Play). We receive confirmation of purchase and subscription status, but not your full payment card details.
Geolocation. We use a third-party IP geolocation service to convert your IP address into an approximate location (country and area), as described in the "Location" section above.
Analytics and crash reporting. We may use analytics and crash-reporting providers to understand how the App is used and to diagnose and fix problems, so we can improve performance and stability.
Hosting and storage. Your account data is stored with our cloud hosting and database providers, who process it on our behalf under appropriate contractual safeguards.
How We Disclose Personal Information
In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy, including: with Shopify, vendors and other third parties who perform services on our behalf (for example IT management, payment processing, data analytics, customer support, cloud storage, fulfilment and shipping); with business and marketing partners to provide marketing services and advertise to you, who will use your information in accordance with their own privacy notices; when you direct, request, or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of login integrations; with our affiliates or otherwise within our corporate group; and in connection with a business transaction such as a merger or bankruptcy, to comply with applicable legal obligations, to enforce applicable terms or policies, and to protect or defend the Services and the rights of our users or others. We do not sell your health data or your progress photos and videos, and we do not use them for advertising.
Relationship with Shopify
The Store is hosted by Shopify, which collects and processes personal information about your access to and use of the Store in order to provide and improve it. Information you submit to the Store will be transmitted to and shared with Shopify, as well as third parties that may be located in countries other than where you reside, in order to provide and improve the Store. Third-Party Websites and Links
The Services may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated with or controlled by us, you should review their privacy and security policies and other terms. We do not guarantee and are not responsible for the privacy or security of such sites.
Children's Data
The Services are not intended to be used by children, and we do not knowingly collect any personal information about children under the age of majority in your jurisdiction. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the details below to request that it be deleted.
Security and Retention of Your Information
Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." Any information you send to us may not be secure while in transit. How long we retain your personal information depends on factors such as whether we need it to maintain your account, provide the Services, comply with legal obligations, resolve disputes, or enforce our contracts and policies.
Your Rights and Choices
Depending on where you live, you may have some or all of the following rights in relation to your personal information: the right to access or know what personal information we hold about you; the right to request deletion of your personal information; the right to correct inaccurate personal information; the right to portability of your personal information; and the right to manage communication preferences, including opting out of promotional emails at any time using the unsubscribe option in our emails.
If you reside in the UK or European Economic Area, and subject to local law, you may also object to or restrict our processing of your personal information for certain purposes, and withdraw consent where we rely on it (without affecting the lawfulness of processing before withdrawal).

Complaints

International Transfers
We may transfer, store and process your personal information outside the country you live in. If we transfer your personal information out of the UK or European Economic Area, we rely on recognised transfer mechanisms such as the UK International Data Transfer Agreement or the European Commission's Standard Contractual Clauses, unless the transfer is to a country determined to provide an adequate level of protection.

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for operational, legal, or regulatory reasons. We will post the revised Privacy Policy, update the "Last updated" date, and provide notice as required by applicable law.
